CBD in the UK – Is it Legal?

CBD is a compound found in cannabis and hemp plants. While cannabis contains many compounds including THC, which can cause psychoactive effects, CBD does not. The fact that it does not make you high means it can be sold legally in the UK. This has led to a boom in the sale of CBD products, from oils to gummies and capsules.

However, some CBD companies appear to be slipping illegal cannabis compounds into the supply chain. A study by the Centre for Medicinal Cannabis (CMC) has found that over half of the products it tested in UK high street shops didn’t have the amount of CBD stated on their label. Moreover, almost all of them contained traces of tetrahydrocannabinol (THC), the psychoactive compound that causes a cannabis high.

The CMC report was the result of an experiment that involved purchasing over-the-counter CBD wellness products from the UK’s leading high-street and online retailers. The products were sent for laboratory analysis by the CMC. Of the 50 products purchased, 47 did not contain the amount of CBD claimed on the product label, with some even containing THC and cannabinol (CBN), which are both psychoactive compounds found in cannabis. In fact, only two of the samples had enough CBD to make them a Schedule 5 controlled drug, meaning that they could be prescribed by doctors as a treatment for certain conditions.

In the UK, CBD is already legally available on prescription for certain conditions. The NHS prescribes a CBD-based medicine called Epidyolex, which has been found to reduce seizures in patients with a severe form of epilepsy known as Dravet syndrome or Lennox-Gastaut Syndrome who do not respond to other antiepileptic medications. It is also approved to treat nausea and vomiting caused by chemotherapy and to reduce muscle stiffness and spasms in people with multiple sclerosis.
